8 R e g u l a t i o n s Scaffolding is work equipment, made up of elements erected on a temporary basis that form elevated work stations and allow access to them and the conveyance of the products and materials needed to carry out works (see art.1 of the ministerial order dated 21 December 2004 ). Current French regulations for scaffolding cover three basic aspects: all designers, erectors and uses must have received training, each scaffold must be erected according to a drawing with load calculations and the legal responsibility for the scaffold rests with the chief executive of the company using the scaffold . The regulatory framework is defined by a decree, an order and a circular from the ministry of labour and a recommendation by the CNAMTS. In particular: • The decree of 1st September 2004 and the circular of 27th June 2005 All persons designing, erecting, modifying dismantling, inspecting or using a scaffold must have received appropriate training (Cf. art. R.4323-69 ). All scaffolds must be erected to a drawing with load calculations unless the configuration is described exactly by the manufacturer(Cf. art. R.4323-70 and R.4323-71 ). Components must be from the same supplier and may only be used in the conditions for which they have been tested (Cf. art. R.4323-72 ). Appropriate protection against the risk of falling from heights must be ensured before accessing any levels of the scaffolding (See art. R.4323-70 and R.4323-71 ). • The CNAMTS recommendation R408 of 10th June 2005 This recommends that MDS guardrails should be erected from a lower level that is already complete with guardrails as specified in the decree above. (Cf. art. 5.3 ). • Order of 21st December 2004 The chief executive of the company using the scaffold is responsible for daily and quarterly inspections of the scaffold. Similarly, he is required to carry out a suitability examination, to ascertain that the scaffolding is suitable for the works he will carry out (See art 3 ). Regulations In France, the standards are optional. They are therefore not mandatory. However, CNAM recommends using scaffolding compliant with current standards ( R408 of 10/06/2004). The Multicrab scaffolding complies with standards NF EN 12810 and NF EN 12811 , as attested to by the right to use the NF mark on the Entrepose Échafaudages product range. All standards governing scaffolding products are detailed in the Professional Guide of the Syndicat Français de l'Échafaudage, du Coffrage et de l’étaiement (SFECE). CE marking Scaffolding, whether or not with Afnor Certification and licence to use the NF mark, does not have CE marking. This is because scaffolding is not subject to European directives known as "new approach" directives that impose such marking (full list on www.afnor.org ) . Equipment from different sources Article R233-13-33 of decree 2004-924 dated 1 st September 2004 states that “The sturdiness and strength of the constituent materials of scaffolding must be fit for its purpose. Assemblies must be made safely, using compatible elements from the same source and in the conditions for which they were tested”. Circular DRT 2005/08 dated 27 June 2005 clarifies the subject of compatibility: “The compatibility of assembly elements (structure) is ascertained through tests carried out by the manufacturer or under the latter's responsibility. Elements not sourced from the same manufacturer are thus not deemed compatible inasmuch as their compatibility has not been tested.” The characteristics of our CRAB range are justified through tests; if this equipment is combined with equipment from a range not presented in this technical manual or of different origin, it is therefore impossible to justify the firmness of such scaffolding by calculation. Mixing models of equipment not presented in this technical manual may lead to failure or accidents. In the event of failure or accident, the erector or user is deemed liable if he has disregarded the recommendations made in the technical manual. Scaffolding class The scaffolding structure must be checked according to the working load on work surfaces. Use of scaffolding classes: • Class 1 (0.75 kN/m 2 ) with class 2 decks is provided for inspection and works with lightweight tools and without storing of materials. • Classes 2 (1.50 kN/m 2 ) and 3 (2 kN/m 2 ) is provided for inspection and operations not involving storage of materials, apart from those immediately required, for instance paintwork, refacing, weather-proofing, plastering … • Classes 4 (3 kN/m 2 ) and 5 (4.50 kN/m 2 ) are provided for brickwork, concreting… • Class 6 (6 kN/m 2 ) is provided for heavy masonry work and for large stores of materials.
